Encumbrance Clause
An Encumbrance Clause is a clause setting forth any encumbrances on the real property conveyed, such as mortgages, leases, liens, easements, or restrictions. Includes taxes, assessments, and all liens on real property. Also includes a deed of trust and any other right to, or interest in, property which may subsist in another to the diminuition of its value but consistent with the passing of the fee, and everything that charges, burdens, obstructs, or impairs the property’s use or impedes its transfer.
